The event itself will explore effective cost and risk containment within litigation for corporate counsel throughout 10 distinct round-table sessions led by eDiscovery experts. On day one of the event, Rubenstein will present in the third session entitled The New Scope of Discovery-Rule 26(b) (1) - Proportionality - Sea Change or Minor Tweak? During this roundtable discussion, he will cover limited preservation based on prospective proportionality as well as dive into if proportionality can be achieved without transparency. On day two, he will moderate session seven, The New Rule 37(e) - Preservation & Sanctions, where he will provide commentary on the intent-to-deprive standard, how this standard has impacted levied sanctions and what supplementary action is needed beyond legal hold notices.
